FABIYI JCA(Delivering the Lead Judgment): This is an appeal against the judgment of Odubiyi J. delivered on 9August 1993 while sitting in his appellate jurisdiction at the High Court of Justice, Abeokuta, Ogun State over the judgment of Grade 1 Customary Court, Obafemi/Owode delivered on 9 June 1992. The respondent, as plaintiff, at the trial Customary Court, claimed against the appellant, as defendant thereat, as follows: “1. Declaration of title of ownership of the piece or parcel of land situate, lying and being at Isiun village, belonging to my father, Pa John Taiwo Odukoya, into which Madam Ayisatu Ogunmuyiwa unlawfully entered.
