HARUNA SIMON TSAMMANI, J.C.A. (Delivering the Leading Judgment):This appeal is against the judgment of the Ogun State High Court delivered by Hon. Justice A. A. Akinyemi on the 12th day of March, 2007 in Suit No: HCT/247/1999.
The Appellants herein, as Plaintiffs before the trial Court, initiated the action against the Respondents (Defendants) vide a Writ of Summons filed on the 29/10/1999. By the Amended Statement of Claim dated and filed on the 27/7/06, the Plaintiffs (now Appellants) claimed as follows:
1. Declaration that the sale by the 3rd and 4th Defendants of the Plaintiffs family portion of land encompassed in the Ikotun families land at Iyana Iyesi Village, Idiroko Road, Ota to the 1st Defendant through the 2nd Defendant is null and void and of no effect whatsoever.
