MARY U. PETER-ODILI J.C.A: (Delivering the Leading Judgment): This is an appeal against the judgment of Hon. Justice A.N. Ajanah of the High Court of Justice, Kogi State sitting at Okene wherein his Lordship dismissed the claim. Being dissatisfied with the judgment of the Court the Appellant filed this appeal before the Court of Appeal.
FACTS
The Appellant is an employee of the Respondent. He was employed as a Chief Security Officer, who was entitled to over-time, settlement of medical bill and payment of certain allowance upon termination of employment. When the Respondent terminated his employment on the ground of economic hardship in the country and general overhead cost of staffing, the Appellant challenged the termination. He also claimed allowances amounting to N1,693,000.00.
The Appellant was not served with letter of termination until much later, but security officers were used to restrain him from site, before serving him letters of termination. The Defendant denied all these…
