UZO IFEYINWA NDUKWE-ANYANWU, J.C.A. (Delivering the Leading Judgment): This is an appeal against the Judgment and Ruling of the High Court of Ondo State delivered by Hon. Justice A. O. Adebusoye on the 31st of March, 2011 and 12th of December, 2011.

By a Writ of Summons filed on 17th February, 2010 together with a Statement of Claim dated 22nd April, 2010, the Respondents as Claimants claimed before the trial Court as follows:-

i. A declaration that the Plaintiffs and their family members are entitled to the right of occupancy over a piece of land lying and situate at Ioka, Oroke, Akure, Ondo State. This is bounded as follows: 1st side by Ejides farmland, 2nd side by Odutolas farmland, 3rd side by Iya Ogunbis farmland and 4th side by Ojo Uyis farmland.

ii. The sum of N500,000.00 being the general damages for various acts of trespass committed by the Defendants on the said land.
