DENTON-WEST JCA (Delivering the Lead Judgment): The plaintiffs (hereinafter called the respondents), commenced an action against the defendant (hereinafter called the appellant), at the High Court of Ondo State sitting at Ondo Judicial Division, Ondo State, vide a writ of summons issued on 30 August 2007 and an amended statement of claim dated 26 April 2010 and filed on 27 April 2010.
