TSAMIYA JCA (Delivering the Lead Judgment): This is an appeal against the judgment of the Federal High Court (herein referred to as the ‘trial court’), Ilorin Division, delivered on 7 A July 2009, wherein the trial court dismissed the entire case of the plaintiff.

By paragraph 75 of the plaintiff’s statement of claim filed on 18 March 2008, the plaintiff sought the following reliefs against the defendants jointly and severally:

A declaration that the purported dismissal of the plaintiff fr om the Univer sity of Ilor in by the defendants’ letter of 13 August 2007 is null and void and of no effect whatsoever. A declaration that the finding of misconduct by the de fe ndants aga inst the plaintiff is obnoxious, untenable, null and void.

An order setting aside both the letter of 13 August 2007 and the findings of misconduct against the plaintiff. A declaration that the plaintiff is still in the services of the 1st defendant until his retirement due date.
