TANI YUSUF HASSAN, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the FCT High Court, Abuja delivered on the 7th day of December, 2010 by Honourable Justice L U. Bello in Suit No.FCT/HC/CV/1258/2006.
By a Writ of Summons and Statement of claim dated 20th day of March, 2006 and filed on 21st March 2006, the appellant as plaintiff at the Lower Court instituted an action against the respondents as defendants therein claiming jointly and severally as follows:
a) A declaration that the plaintiff is the rightful holder of letter of offer for sale in respect of Flat 15 Block 504, Bissau Street Zone 6 Wuse Abuja.
b) A declaration that in the circumstances of this case, there is a valid and subsisting contract for sale of Flat 15, Block 504, Bissau Street, Zone 6 Wuse Abuja between the plaintiff and the 2nd to 4th Defendants.
