NWOSU-IHEME, J.S.C. (Delivering the Leading Judgment):This appeal arose from the judgment of the Court of Appeal, Benin Division (“the lower court”), Coram: Hon. Justice Philomena MbuaEkpe, JCA (Presiding), Hon. Justice Mudashiru Nasiru Oniyangi, JCA and Hon. Justice Ugochukwu Anthony Ogakwu, JCA (Read the Lead Judgment), delivered on 8th June, 2016, affirming the decision of the Delta State High Court of Justice (“the trial court”),Coram: Hon. Justice C.O. Ogisi delivered on 1st July 2013.
The lower court affirmed the trial court’s conviction of the appellant for the offences of conspiracy to commit robbery and armed robbery contrary to Section 1(2)(a) of the Robbery and Firearms (Special Provisions) Act, Cap. R11, Volume 14, Laws of the Federation of Nigeria, 2004.
