TOM SHAIBU YAKUBU JCA (DELIVERING THE LEADING JUDGMENT): This appeal is against the judgment of the Anambra State High Court of Justice, holden at Nnewi, which was delivered on 22nd June, 2012 in favour of the respondent. The reliefs prayed for by the respondent in her amended statement of claim were namely:-

(a) A declaration that the plaintiff is the person entitled to the grant of statutory right of occupancy in respect of Chukwuanu the land known as the compound of late Simon Okeke situate at Ndimgbu, Otolo, Nnewi.

(b) A declaration that the plaintiff is the person who inherited the estate of late Simon Okeke.

(c) A declaration that the defendant is not entitled to inherit the estate of late Simon Okeke or any part thereof.

(d) An injunction restraining the defendant, his agents, servants or privies from further challenging or disturbing the plaintiff in her use and occupation of the compound of late Simon Okeke or his other estate wherever situate.
