ONYEKACHI AJA OTISI, J.C.A. (Delivering the Leading Judgment): This appeal was lodged against the judgment of the National Industrial Court of Nigeria (NICN), Lagos Judicial Division, Coram B.B. Kanyip, Ph.D, J. (now President of NICN), delivered on April 15th, 2015, in which only part of the Appellant’s claims was granted, while other claims were refused.
The facts leading to the appeal may be summarized in this manner: the Appellant was employed by the Respondent as a Commercial Director, which appointment took effect from 11/1/2011. The letter of appointment stipulated the conditions for the Appellant’s appointment and schedule of duties. By the said letter of employment, he was entitled to an annual bonus that would be discussed and agreed upon after a period of one year. Pursuant to this clause, the Appellant averred that he held a discussion with the Respondent’s Chief Executive Officer, Mr. Jacques J.
