(Delivering the Leading Judgment): By an Amended Information with proof of evidence, filed on 12th December, 2008 the Appellant together with four others, to wit; BARIDOSA ROBERT, APOSTLE GONEE, LENEE OKERE and GOODLUCK OKERE were arraigned before the High Court of Rivers State, Bori Judicial Division, M. O. OPARA J. presiding, for the following offences: -
STATEMENT OF OFFENCE
CONSPIRING TO MURDER, contrary to Section 324 of the Criminal Code Law (Cap. 37) Laws of Rivers State of Nigeria 1999.
PARTICULARS OF OFFENCE:
BARIDOSA ROBERT, APOSTLE GONEE, LENEE OKERE, KINGDOM OKERE, GOODLUCK OKERE, GODFREY GBENEE TEE-BEKE and others now at large on the 3rd day of December, 2006 at Baa-Lorre Community in the Bori Judicial Division, did conspire to kill Apostle Elijah Okeke Andrew.

MURDER, Contrary to Section 319(1) of the Criminal Code (Cap. 37) Laws of Rivers State 1999.
