OGUNTADE, JCA (Delivering the Lead Judgment): In suit No. ID/ 573/84 at the Ikeja High Court of Lagos State, the respondents, as plaintiffs claimed against the appellants, as the defendants the following reliefs:- “(i) ... the order of this Honourable Court appointing the 1st defendant i.e. the Administrator-General and Public Trustee as trustee of the Estate of Abibu Oki Balogun in respect of “all messuages, lands, tenements, hereditament and real estate whatsoever and wheresoever not herein before specifically bequeathed in the last Will and testament of Abibu Oki Balogun be terminated forthwith and the plaintiffs appointed Trustees of the said estate.
