AKPIROROH, JCA (Delivering the Lead Judgment): This is an appeal against the judgment of Ononuju, J. of the High Court of Umuahia Judicial Division, holden at Umuahia, delivered on the 30th day of March, 1987, in suit No. HU/52/71.

The plaintiffs’ claim as endorsed in their statement of claim is as follows:-

Declaration of title to all those pieces or parcels of land known as and called (1) Akwu-Eko (2) Iyi-Eruru (3) Egbu Anya-Iji

(4) Egbu-Abuo-Uturukpa (5) Koko-Obina, all of annual rental value of N10.00, situate at Amaelu village, Abam Clan, Ohafia Division within the judicial division of this Honourable Court.

N400.00 being general damages for trespass.
