JOSEPH TINE TUR, J.C.A. (Delivering the Leading Judgment): The appellants were the plaintiffs in the High Court of Justice of Anambra State holden at Nnewi. They instituted an action against the respondents who were defendants on 20th April, 2007. Paragraphs 1-6 of the statement of claim pleaded the following facts:

1. The plaintiffs are members of Umuonyedibe family of Enugwu-Adazi village, Adazi-Enu in Anaocha Local Government Area of Anambra State within the jurisdiction of the Honourable Court and they bring this action for themselves and on behalf of Umuonyedibe family of Enugwu-Adazi village, Adazi-Enu.

2. The first plaintiff is a farmer and the head of Umuonyedibe family, the second plaintiff is the first son of the first plaintiff, the third plaintiff is a farmer, the fourth plaintiff is a lecturer at Federal Polytechnic Oko while the fifth plaintiff is a teacher.

3. The defendants are all farmers and members of Umudinigwe family in Enugwu Adazi village Adazi-Enu and they are sue…
