RAPHAEL CHIKWE AGBO, J.C.A. (Delivering the Leading Judgment): This interlocutory appeal ought not to be brought in the 1st instance. It is challenging the order of the trial Judge transferring the matter to the Chief Judge for assignment to another Judge. That cannot be the subject matter of an appeal to this Court. This appeal is dismissed. The case is referred to the Chief Judge of Abia State for Assignment to another Judge to hear it on the merits.
