KOLAWOLE, J.C.A. (Delivering the Leading Ruling): This is an application for bail pending the hearing of an appeal. The application is made under Section 29(1) of the Court of Appeal Act, 1976. The subsection provides that -

"The Court of Appeal may, if it thinks fit, on the application ofan appellant, admit the appellant to bail pending the determination of his appeal."

Mr. G. O. Soremi, Learned Director of Civil Litigation, Ogun State, did not oppose the application as they did not do before Oduyemi, J. in the lower court.

The applicant was convicted at the High Court of Justice, Ogun State, holden at Abeokuta for the offence of receiving stolen property, contrary to Section 427 of the Criminal Code (Cap. 29), Laws of Ogun State of Nigeria, 1978, and was sentenced to a term of three years imprisonment on 10th July, 1990 The applicant has duly lodged an appeal against the conviction and sentence upon a number of grounds.
