AKPIROROH, J.C.A. (Delivering the Leading Ruling): By a motion on notice dated 27th November, 1998 and filed on 30th November, 1998, the applicant is praying the court for the following orders:-

(A)An Order granting leave to the Appellant to amend the Notice of Appeal dated the 30th day of July, 1980 as shown on pages 41-43 of the Records of Appeal in the terms of the document annexed to the Affidavit in support of this application and marked as EXHIBIT 'A'.

(B)An Order granting leave to the defendant/applicant to further amend the Appellant's Amended Brief of Argument filed in this Honourable Court, dated the 13th day of November, 1986 as contained on pages 66-70 of the Records of Appeal by recasting the Appellant's Amended Brief as shown in Exhibit 'B' exhibited to the Affidavit in support of this Application.

(C)Deeming the said Exhibits 'A' and 'B' as having been filed and served."
