RIDWAN MAIWADA ABDULLAHI, J.C.A. (Delivering the Leading Judgment): The proceedings which gave rise to this appeal commenced at the Ondo State High Court No. 3, holden at Akure where the Applicant instituted an action under the Fundamental Rights (Enforcement Procedure) Rules 2009, against the Respondents.
The Applicant sought the following reliefs against the Respondents:-
1. A declaration that the threat by the Respondents to re-arrest the applicant for demanding for the release and return of his properties Viz:
(1) Mack Trailer with Registration Number XB120 GMD, Oyo State
(2) Serena Bus with Registration Number AL 903 AKN Oyo State,
