ADEKEYE, JCA (Delivering the Lead Judgment): The appellant - Moshood Oladimeji and four others - YekiniAkanbi, Mudeen Kasali, Olumide Olajide and Mumini Oladimeji, were arraigned before the Ibadan High Court, Oyo State, on a one-count charge for the murder of Agboola Aina contraryto and punishable under section 319(1) of the Criminal Code, Cap 30, Volume 11, Laws of Oyo State 1978. The summary of the facts as presented before the trial court are that Agboola Aina now deceased set out accompanied by his sister Wilemotu Ayantola from Dada Village Idi Ayunre - on a journey to Ibadan. He was to appear as a complainant before the Magistrate’s Court Iyaganku on the 2nd of February 1996. On their way all the people mentioned above and others now at large waylaid them in respect of a protracted land matter between their Lakun Oladimeji Branch of the Dada family and the deceased, Agboola Aina.
