MODUPE FASANMI, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the Oyo State High Court sitting in Ibadan in Suit No. I/825/2017 delivered on the 31st of July 2017.
The Respondents instituted the action at the lower court by an originating summons dated 4th of July 2017 and filed on the 5th of July 2017 seeking the following reliefs:
1. A DECLARATION that the 1st Claimant as National Chairman of the All Progressives Grand Alliance (APGA) can only be removed from office as the National Chairman in strict compliance with the provisions of Article 20 (3) (b) of the 2014 constitution of the All progressives Grand Alliance (APGA).
2. A DECLARATION that members of the National Working Committee (NWC) of the party (APGA) cannot remove the 1st Claimant from office as the National Chairman of the party except as provided by Article 20 (3) (b) of the 2014 Constitution of the All Progressives Grand Alliance (APGA).
