GALINJE JCA (Delivering the Lead Ruling): The applicant herein was convicted for an offence of stealing and sentenced to two years imprisonment by the Lagos State High Court on 1 February 2008.

Dissatisfied with the decision of that court, she appealed to the Court of Appeal. The notice of appeal is dated 15 February 2008 and filed the same date. Having therefore filed the appeal, the applicant has brought this application by way of motion on notice dated and filed on 4 July 2008, seeking for an order admitting her to bail pending the determination of the appeal.

The motion on notice which is brought pursuant to Order 7, rule 1; Order 16, rule 13 of the Court of Appeal Rules, 2007, sections 15, 18(1) of the Court of Appeal Act 2004 and the inherent powers of the court, is supported by a 33-paragraph affidavit, sworn to by Bolanle Olamolu, the daughter of the applicant.
