MONICA BOLNAAN DONGBAN-MENSEM, J.C.A.(Delivering the Leading Judgment): This appeal challenges the ruling of the Oyo State High Court Ibadan Coram Hon. Justice M. O. Bolaji-Yusuff (AHTW) delivered on the 5th day July, 2010 setting aside the writ of execution and warrant of possession issued by the Appellants against the Respondents and executed against respondents who were found on the land in dispute.
For the ease of reference, the parties erroneously described as Defendant shall be referred to as the 1st set of Respondents while the Respondent will be referred to as the 2nd set of Respondents. The Appellants remain the Appellants. All the parties will be so referred to in this Judgment.
Dissatisfied, with the said ruling the Appellants have appealed to this Court on four grounds of appeal as contained in their Notice of Appeal dated the 14th day of September, 2010 and filed on the same date.
