A copy of the application was served on the respondents to the motion who reacted by filing a counter-affidavit to the motion on the 15th of April, 2003. At the time, the application was heard by this court facts in support of the application were as deposed to by the applicant in a 12 paragraph affidavit, to which was attached the conditions of appeal as exhibit A.
