YARGATA BYENCHIT NIMPAR, J.C.A. (Delivering the Leading Judgment): This Cross Appeal is against the decision of the National Industrial Court sitting in Abuja delivered by HON. JUSTICE SANUSI KADO on the 26th February, 2019 wherein the lower Court entered judgment in favour of the Cross-Appellant by holding that the Cross-Respondent’s Staff Regulations Handbook, under which the Cross-Appellant was tried and punished, was not validly made because it was approved by the Chairman of the Cross-Respondent and not by the Board of the Cross-Respondent thereby the disciplinary procedures conducted against the Cross-Appellant pursuant to the said Cross-Respondent's Staff Regulations Handbook was null and void. The trial Court also held that Cross-Respondent breached the Cross-Appellant's right to fair hearing because he was not invited to appear in person by the disciplinary committee. Dissatisfied with the said decision, the Cross-Appellant filed this Cross- Appeal.
