ABUBAKAR SADIQ UMAR, J.S.C. (Delivering the Leading Judgment): This is an appeal against the judgment of the Court of Appeal, Lagos Judicial Division (lower court), delivered on 22nd July, 2013 wherein the lower court affirmed the conviction and sentence of the appellant ina judgment delivered on 27th September, 2012 by the High Court of Lagos State, Ikeja Judicial Division (trial court). The appellant being dissatisfied with the decision of the lower court has therefore filed the instant appeal with the view to upturn the concurrent judgment of the courts below.

The appellant and one entity described as Landmark Bureau De Change (2nd defendant at the trial court) were charged and arraigned before the trial court vide an information dated 18th November, 2010, containing a 2-count charge of stealing contrary to section 390(8)(b) of the Criminal Code Law of Lagos State, 2003 and issuing Dishonoured Cheque contrary to section 1(1)(b) of the Dishonoured Cheque (Offences) Act, 2004.
