GALADIMA, J.C.A. (Delivering the Leading Ruling): The appellants/applicants who were the plaintiffs before the lower court have brought this application praying for the following:
1.An order of injunction restraining the respondent, either by herselfagents, servant, privies or whosoever is acting on her behalf from demolishing the applicant's building on the land the subject matter in Suit No. ID/332/98 or in any matter whatsoever, disturbing the applicants' possession and quiet enjoyment of the said land pending the determination of the substantive appeal herein.
Alternatively
2. An order suspending the execution of the warrant of possession said to have been issued by Honourable Justice A. A. Adesanya permitting the respondents to levy execution in respect of the declaratory judgment in Suit No. IK/170/71 pending thedetermination of the substantive appeal herein."
