OMAGE JCA (Delivering the Lead Judgment): This is an appeal by the appellant on the rulings of Justice Abass J, of the Oyo State High Court; and of Justice Sanda of the Oyo State High Court. The appellant filed his brief on 29/9/03. He also filed a reply brief on 3/11/03. The respondent’s brief was filed on 28/10/03.

Both counsel adopted their briefs before us today. The issue in the decisions of the court below is whether the decision was right (sic) made by Abass J, when averred by the appellant the learned trial court did not agree to renew the bail in the court he presided on (sic). His Lordship Justice Ige of the Oyo State High Court before whom the case was previously, had in his exercise of his discretion granted bail to the accused person when he was arraigned before him. The charge against the accused person was transferred to the Hon. Justice Abass, which (sic) the charge was read to the accused person; and the case started de novo.
