ONNOGHEN JCA (Delivering the Lead Judgment): This is a consolidated appeal against the decision of the National Assembly/ Governorship and Legislative Houses Election Petition Tribunal, holden at Awka, Anambra State in petition Nos. EPT/AN/HA/80/2003 and EPT/ AN/HA/69/2003 delivered on 8th March, 2004 in which the Tribunal held that “petition No. EPT/AN/HA/69/2003 succeeds. We order that INEC within 30 days organise a bye-election for Aguata 1 Constituency of Anambra State subject however to appeal being filed”. Against that judgment three appeals have been filed and also a cross-appeal. The appellants are as indicated in the parties to this consolidated appeal and include Independent National Electoral Commission the body charged with the responsibility of conducting the election in issue.
