OBADINA JCA (Delivering the Lead Judgment): This is an appeal against the decision of the Federal High Court sitting at Jos contained in the judgment delivered on the 25th of January, 2001 in suit No. FHC/CS/17/99. The appellants were the plaintiffs, while the respondent was the defendant at the trial court.
The plaintiffs/appellants’ case is that between December, 1992 and February, 1993, the plaintiffs entered into an oral agreement with the Faculty of Medical Sciences of the defendant university whereby, the 1st plaintiff/appellant was appointed as consultant to produce designs and architectural models for an office building and laboratories to be built on the defendant’s premises of Jos University Teaching Hospital and a twin lecture theatre to be sited on the Bauchi road campus of the defendant university. The estimated cost of the two projects was N80,000,000 (eighty million naira), which was to be raised by the defendant through appeal fund launching.
