TUNDE OYEBANJI AWOTOYE, J.C.A. (Delivering the Leading Judgment): This is the judgment in respect of the appeal filed by Chief Ebenezer Onwuka, the Plaintiff at the lower Court in Suit No. FHC/UM/CS/23/2005. Chief Ebenezer O. Onwuka V. Nigerian Ports Authority decided on 30/9/2013.

The Appellant instituted an action against the Respondent at the lower Court claiming as per paragraph 32 of his Statement of Claim as follows:

Accordingly; the Plaintiff hereby prays the Honourable Court for the following:

(a) A declaration that in 1971 when the Plaintiff voluntarily retired from the employment of the Defendant, the Currency that was in use in Nigeria then was the British pound sterling.

(b) A declaration that at the time the Plaintiff voluntarily retired in 1971, there was no such currency as the Nigeria Pound, inferior to the British Pound sterling.
