PETER OLABISI IGE, J.C.A. (Delivering the Leading Judgment): This Appeal is against the Judgment of the Imo State High Court contained in the judgment of U. D. UGWURUIKE, J. delivered on the 28th day of March, 2012.
The Respondent, Chief Godwin Anaejionu who is a native of UMUAGHARA OBIBII in NGURU NWEAFOR AUTONOMOUS COMMUNITY in Aboh Mbaise Local Government Area of Imo State sued the following persons at the lower court viz:

3. CHRISTIAN ONYENWE And
4. NDUBUISI JOSEPH MARY NJOKU
Claiming as follows:
