THOMAS JCA (Delivering the Lead Judgment): This is an appeal by1st defendant, now appellant against the judgment of Edemekong I. Edemekong, J. of Uyo Judicial Division of Akwa Ibom State in suit number HU/347/98 delivered on 19/8/99. By an originating summons, the respondents who were plaintiffs, claimed the following reliefs: “1. A declaration that the plaintiffs are still in the employment of the defendants and accordingly, entitled to their salaries, allowances, fringe benefits and other perquisites with effect from 1st March, 1997 when their salaries and allowances were purportedly withheld.
