UGO JCA (Delivering the Lead Ruling): By this application, the applicant, Prince James Adeleke Osayomi seeks an order of this court extending time within which he can appeal against the ruling of the Ekiti State High Court sitting at Ado-Ekiti, coram Akintayo J., delivered on 4
August 2011in suit No. HIJ/20/93, between Prince James Adeleke Osayomi (the applicant) and Others v. Government of Ekiti State and 5 Others , in which the learned trial judge, in upholding a preliminary objection by the 3rd and 4th defendants, struck out the said suit on the grounds that the statement of claim of the applicant (plaintiff therein) was neither signed nor dated or even filed.
