OBADINA, JCA (Delivering the Lead Judgment): The appellant who was the plaintiff at the High Court, was the Dean, Faculty of Medical Sciences of the University of Jos. According to the University of Jos Act, a Dean of a Faculty has a term of two years and could be re-elected for another term. The appellant was elected the Dean of the Faculty of MedicalSciences for the first term in 1992. Towards the end of his tenure as the Dean of the Faculty on 31st August, 1994, the Faculty Board organised a fresh election which was fixed for 19th July, 1994. The notice of the meeting for the election was circulated to all the members of the Faculty Board, including the 2nd respondent i.e. The Vice-chancellor of the University of Jos. To contest the election two candidates were nominated namely - the appellant. (Prof. J.A.M. Otubu) and Prof J. 0. Ibu.
