UZO IFEYINWA NDUKWE-ANYANWU, J.C.A. (Delivering the Leading Judgment): This is an appeal against judgment of the High Court of Ondo State delivered on 28th March, 2014 by Hon. Justice A. N. Ubaka.

By a general form of complaint the Claimant now Respondent claimed against the Defendant now Appellant as follows:

a. the sum of N388,103.00 (Three Hundred and Eighty-eight Thousand, One Hundred and Three Naira) only being his unpaid entitlement as at 9th march 2012 which the Defendant has failed, refused and neglected to pay in spite of several demands.

b. the sum of N1,000,000.00 (One Million Naira) only as general and aggravated damages.

The Appellant as Defendant on their part entered appearance and filed a Statement of Defence.
