TINUADE AKOMOLAFE-WILSON, J.C.A. (Delivering the Leading Judgment): This is an appeal against the ruling of the Code of Conduct Tribunal presided by Hon. Justices Yakubu Umar and Agwadza Atedze delivered on 20th October, 2016.
The appellant, a retired public officer, who rose to the rank of Comptroller of Customs was arraigned before the Tribunal by the respondent on a one count charge for failure to declare his assets throughout his career as a public officer. The appellant immediately filed a preliminary objection challenging the competence of the charge filed against him. The Tribunal by a considered Ruling dismissed the objection and set the case down for hearing. The appellant dissatisfied, lodged an appeal against the Ruling and filed an application for stay of proceedings pending the determination of the appeal.
