STEPHEN JONAH ADAH, J.S.C. (Delivering the Leading Judgment): This appeal arose from the judgment of the Court of Appeal, Ilorin Judicial Division, delivered on 16th December, 2021, in Appeal No. CA/IL/9C/2021. In its judgment, the lower Court affirmed the decision of the High Court of Justice, Kwara State, sitting at Ilorin, in Charge No: KWS/14C/2017. The trial Court had convicted the appellant together with three other accused persons and sentenced them to two years' imprisonment on count six, two years' imprisonment with an option of fine in the sum of N25,000 on count five, and to death by hanging on counts one, two, three, and four respectively.

Aggrieved by the judgment of the lower Court, the appellant has further appealed to this Court.
