OKUNOLA, J.C.A. (Delivering the Leading Judgment): This is an appeal by the 1st defendant/appellant against the decision of the Oyo State High Court holden in Oyo contained in the ruling of Aderoju Aderemi J. dated 1/11/88 in suit No HOY/10/88.

The facts of this case briefly put were as follows:- The 1st respondent herein as plaintiff sued the appellant herein along with the other respondents herein as defendants claiming as per page 2 of the records as follows:-

(a)Declaration that under and by virtue of the customary law regulatingthe selection of the Onaonibode of lgboho chieftaincy as declared in the Onaonibode of lgboho chieftaincy declaration duly approved and registered in 1959, the Onigboho of Igboho is, from time immemorial, the traditional chairman of the "kingmakers" to Onaonibode of lgboho chieftaincy.
