ABDU ABOKI, J.C.A (Delivering the Leading Judgment): This appeal is against the Ruling of the Federal High Court, Kaduna delivered on 26/3/2010 by M. L. Shuaibu J.
The facts giving rise to the appeal are that in April 2007, the 3rd Respondent upon the instruction of the 2nd Respondent sent a circular to the Chairman of Sub-Committee Central Appointments and Promotion Committee of the 1st Respondent concerning the guidelines for the promotions of the senior staff of the 1st Respondent.
In the said circular, the 3rd Respondent directed that has in formulating the recommendations for promotion, the 1st Respondent's existing guidelines of 1988 as modified should be used, Aggrieved by that directive the Appellants wrote a letter dated 25th April 2007 addressed to the 2nd Respondent, who was also the Chairman of the 1st Respondents Central Appointment and Promotions Committee complaining about the criteria to be used for the promotions.
