CHUKWUMA-ENEH, J.C.A. (Delivering the Leading Ruling): This is an application by way of a motion on notice supported by an affidavit of 8 paragraphs for an order to correct the clerical slip or error in the enrolled order of the court of conditional stay of execution delivered on 7/7/98 and enrolled on 22/5/2002 wherein the Deputy Chief Registrar of this court i.e. Court of Appeal Lagos is ordered to deposit the said judgment debt i.e. N7,100,000 with accrued interest at 71/2% interest of 21 % per annum from February, 1995 to 3rd July 1998 and % per annum till 22nd May, 2001 into an interest yielding account at the Union Bank Moloney Street, Lagos pending the determination of the appeal at the Supreme Court. In consequences, respondent/applicant has specifically sought that appellant/respondent do further deposit the balance of the sum of N6,686,938 due since 11/6/2001. (italics for emphasis).
