JUDGMENT 

By her amended writ of summons and statement of claim, the Plaintiff claimed against the  Defendant the following reliefs; 

a) An order of specific performance against the Defendant Assembly to construct and  complete store No 53 situate in the Haatso Market with the same standard as other  stores in the market within a reasonable time 

b) An order directed at the Defendant to hand over store No 53 Haatso Market to the  Plaintiff after completion 

c) Perpetual injunction restraining the Defendant, its agents, assigns, third parties or  any person or persons, companies claiming in trust on behalf or through the  Defendant from disposing, selling, letting store No 53 to any third party until the  final determination of this suit.  

d) Costs; or in the alternative; 

i) Order for recovery of the sum of Three Thousand Ghana Cedis (GH¢3,000.00) paid as deposit to the Defendant 

ii) Interest on (i) above at the prevailing commercial bank rate from November 2003 to date of final payment
