JUDGMENT

The Plaintiffs issued out writ of summons against the Defendants on 13th February 2007. They however, filed an amended writ of summons and statement of claim on 29th June 2009 pursuant to this court’s order of 24th June 2009 claiming as follows:

a) A declaration that the late Kojo Amoah in his life time told Plaintiffs and his family, both immediate and extended that in appreciation of the financial assistance towards the putting up of H/no.B455/21 North Kaneshie by the late mother of the Plaintiffs, the said house should be given to Plaintiffs upon his demise.

b) An order directed at the defendant to vest H/No.B445/21 to the Plaintiffs in accordance with the wishes and directives of the late Kojo Amoah.

c) Costs

The first, second and third Defendants have denied that the Plaintiffs are entitled to their claim while the 4th Defendant has admitted that they are entitled to their claim.
