DANLAMI ZAMA SENCHI, JCA (Delivering the Leading Judgement): This appeal is against the Judgment of the Federal High Court in Suit No. FHC/ABJ/CS/1080/2022 delivered on 22nd day of November, 2022 by Honourable Justice Obiora Atuegwu Egwuatu.

The Appellant (as plaintiff) commenced this action by concurrent Originating Summons filed on 6th July, 2022 against the Respondents (Defendants) before the Trial Court. The Originating Summons was amended and filed on 13th October, 2022. By the Amended Originating Summons, the plaintiff seek the determination of the following questions:-

1. Whether by the combined provisions of Sections 66(1)(i), 285 (14 (c), 287 (1) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) and the combined effect of the undisturbed Judgments of the Federal High Court in SUIT NO.  FHC/JAL/CS/1/2019 BETWEEN USMAN UDI and 3 ORS. v. ABUBAKAR SANI DANLADI and 2 ORS., the Court of Appeal in APPEAL NO.CA/YL/41/19 BETWEEN ABUBAKAR SANI DANLADI AND ANOR. V.…
