JUDGMENT
ASUMAN-ADU, J.
Plaintiffs commenced the instant action against the defendants by filing writ of summons together with statement of claim on 5th April 2012 for the following reliefs:
a. Declaration that the late S. C. Appenteng failed or neglected to pay rents to the plaintiffs’ predecessors in title or to the plaintiffs from 1972 to 2008.
b. That the Administrators of the estate of the late S. C. Appenteng are liable to account for the unpaid rents payable from 1972 to July 2008.
c. Interest on the unpaid rents to date of final payments. d. Damages for breach of covenant in the agreement to notice to the plaintiffs for any grants within 3 months.
e. Costs.
Defendants entered appearance on 23rd May, 2012 and went on to file their statement of defence on 28th November, 2012 denying plaintiff’s claim. On 15th February, 2013 plaintiffs filed a reply to defendants’ statement of defence and application for directions raising the following issues:
