OBADINA, JCA (Delivering the Leading Judgment): This is an appeal against the Judgment of Oyetunde J. sitting in Jos Judicial Division of the High Court of Justice, Plateau State. The respondents herein were the plaintiffs, while the appellant was the defendant. The respondents sued in representative capacity. In or about 1975, the Federal Government of Nigeria, through the Federal Ministry of Housing, Urban Development and Environment Lagos, constructed Low Cost Housing Units under Phase 1 of the Federal Government Housing Scheme in all States of the Federation, including the one along Miango Road, Jos, Plateau State, the subject matter of this appeal.
