Kutigi J, in Suit No. FCT/HC/CV/4520/2011: Munaish Investment Limited & Anor V. Polaris Bank Limited delivered on 18/11/2016, wherein reliefs 3 and 4 claimed by Respondents as Claimants was granted against the Appellant as Defendant.
The Notice of Appeal was filed on 30 /11/2016 on five grounds of appeal. See pages 163 - 169 of the Record of Appeal. The Record of Appeal was compiled and transmitted to this Court on 22/6/2017. The Amended Notice of Appeal was filed on 3/7/2020 on two grounds of appeal but was deemed as properly filed on 1//11/2021. The Parties filed and exchange their briers which were adopted as their arguments at the hearing of this appeal on 5/4/2022. The Appellant was represented by Chinenye Aneke Esq. The Respondents were represented by M. I. Akande Esq.
