Since a local court has no jurisdiction in a land case unless the value thereof is shown not to exceed £G200, a plaintiff who institutes a land suit in a local court, or who requires a local court to continue a land suit pending in a local court before the 1st July, 1960, the date on which the Courts Act, 1960 (C.A. 9) came into force, must first establish that the said local court has jurisdiction. Since the plaintiff failed to prove in the case that the local court had jurisdiction, the trial which took place was at his risk as to costs therein. In those circumstances he has to bear all the costs in the local court.
