JOHN INYANG OKORO, JSC (Delivering The Leading Judgement): This is an appeal against the judgment of the Court of Appeal, Lagos Judicial Division In Appeal No. CA/L/647/2012 delivered on 12th January, 2018.
At the High Court of Lagos State, the 1st and and Respondents (as 2nd and 3rd Plaintiffs) took out a writ of summons filed on 21/4/1995 against these Appellants (as defendants) claiming the following reliefs.
Declaration that the 1st - 7th defendants are not members of the Esimikan family of Ilado-Odo and Inagbe.
Declaration that all that piece or parcel of land known as Ilado-Odo and Inagbe Island; are the property of the Esimikan family of Ilado-Odo and Inagbe, who are entitled to the title, general control and superintendence thereof
An injunction restraining the defendants, their agents, servants, privies assigns or otherwise howsoever from entering into, trespassing upon or in any other n1anner interfering with all that land known as Ilado-Odo and Inagbe Islands.
