RULING

The Plaintiff/Applicant filed Writ of Summons against the Defendant/Respondent on 3rd November, 2009 for the following reliefs:

“(1) A declaration that the Defendant is not entitled to unilaterally vary the terms of the Plaintiff’s contract

(2) An order of perpetual injunction to restrain the Defendant, by themselves, their agents, servants, privies whatsoever from unilaterally varying or in any way interfering with the enjoyment by the Plaintiff of the terms of his conditions of service.”

He went on to file motion on notice on the same day for an order to restrain the Defendants from unilaterally varying the terms of the Plaintiff/Applicant’s contract until final determination of the suit which the Defendant/Respondent has opposed. This ruling is, therefore, in respect of the said application.
