UGOCHUKWU ANTHONY OGAKWU, J.C.A. (Delivering the Leading Judgment): The provenance of this appeal is in the Management Agreement between the Appellant and the 1st Respondent. By the said Management Agreement, the Appellant was to manage the 1st Respondent’s rubber plantation situate at Ilushin in Ogun Waterside Local Government Area of Ogun State for a period of twelve years. However, before the agreement ran its course, it was terminated on grounds of breach and non-observance by the Appellant of the terms of the Management Agreement. The Appellant, contending that the said termination of the Management Agreement was invalid, null and void instituted proceedings before the High Court of Ogun State in SUIT NO. HCJ/97/2007: PROJECT VISION ACTUALIZERS LIMITED v. ILUSHIN ESTATES LIMITED and ANOR.

By its Further Amended Statement of Claim, the Appellant, as Claimant before the lower Court, claimed the following reliefs against the Respondents, as the Defendants at the lower Court:
